General terms and conditions

Section 1 Area of validity, customer information
The following general terms and conditions determine the contractual relationship between Solid Bikes Europe and the customers who purchase goods from our online shop. The contract language is German.

Section 2 Conclusion of a contract
1. The items on the internet are a non-binding offer to buy merchandise.
2. You can place one or more products in the shopping cart. Over the course of the ordering process, you enter your data and desired payment method, means of delivery, etc. You only make a binding offer to conclude a contract of purchase once you click on the order button. You may also place a binding order by phone or fax.  The immediate acknowledgement of the receipt of your offer by E-mail or fax does not yet represent a binding acceptance of the purchasing offer.
3. We are entitled to accept your offer within 2 business days of sending an order confirmation by E-mail.  Once the period mentioned in Sentence 1 has expired without any acceptance your request is considered to have been refused, i.e. you are no longer bound by it. If you place an order over the phone the contract is concluded if we accept your offer immediately. If the offer is not accepted immediately you are no longer bound by it.

Section 3 Customer information: storage of your ordering data
Your order with details about the concluded contract (e.g. kind of product, price etc.) will be stored by us. We will send you our terms and conditions but you can also read our terms and conditions on our web site at any time.

As a registered customer, you will have access to your past orders via the customer log-in area (your account).

Section 4 Customer information: correction note
You can always correct your data before submitting your order by using the delete key. We will inform you about further correction possibilities during the actual ordering process. The ordering process can also be terminated at any time by closing the browser window.

Section 5 Reservation of ownership
The purchased item remains our property until full payment has been made. 

Section 6 Statutory warranty rights
1. Statutory warranty rights
Statutory warranty rights apply to our goods.
2. Limitation period
Any claims you may have due to defects in used goods will expire within one year of the date the goods sold are transferred to you. This provision does not apply to damage compensation, claims arising from any potential defects which we fraudulently conceal, and claims from a guarantee we have made regarding the quality of the goods. The statutory limitation periods apply to these claims.

Section 7 Limitations of liability
We exclude our liability for breaches of obligations due to slight negligence as long as they do not affect substantial  contractual obligations, damages due to injury to life, body or health or guaranties, or as far as claims under the German Product Liability Act (Produkthaftungsgesetz) are not affected. The same applies to breaches of obligations committed by our vicarious agents and/or legal representatives. The major contractual obligations include in particular the obligation to deliver the purchased item to the buyer and transfer ownership of it to him or her. We are further more obliged to provide the purchased item free of physical and legal defects.
